EMAIL LEGAL NOTICE


1. Introduction

The Lantern Legal Group Pty Ltd t/a Harwood Andrews (Harwood Andrews, we, us, our) is a law firm dedicated to providing expert advice and legal services (Services). Email is an integral part of our Services and an important means of communicating with clients, service providers and third parties (you). For the purposes of this Email Legal Notice, emails, attachments to emails and links within emails are collectively referred to as ‘email’.

2. Purpose

The purpose of this Email Legal Notice is to regulate the use and receipt of email to and from Harwood Andrews in accordance with the Electronic Transactions (Victoria) Act 2000.

3. Email from Harwood Andrews

Email from Harwood Andrews is intended for named recipients and persons copied in on the email only. Any other persons in receipt of email from Harwood Andrews are unauthorised recipients of that email. Harwood Andrews cannot and will not be liable for unauthorised forwarding and distribution of email.

You, as an authorised recipient, in your personal capacity or as authorised representative of an organisation, agree to receive communications from Harwood Andrews by email.

4. Confidentiality and Privilege of email from Harwood Andrews

Email from Harwood Andrews may contain confidential and/or privileged information. Any dissemination, distribution or copying by persons other than the intended recipient(s) is prohibited. If you are an unauthorised recipient, you must immediately:

  • notify the sender if the sender is a Harwood Andrews representative; or

  • notify Harwood Andrews at privacy@lantern.legal if the sender is a third party.

If you are an unauthorised recipient you must destroy all email in electronic and hard copy format which you have received as an unauthorised recipient and/or have printed without authority.

5. Access, Monitoring and Interception

To comply with the law and in line with international standards and best practice relating to the use of information technology in providing our Services, Harwood Andrews monitors and intercepts live (travelling over telecommunications networks) communications, such as email (blocking, filtering, scanning). Where necessary to manage business risk and if required by law, Harwood Andrews will also access static (archived) information created, received, communicated and stored (processed) by it as part of the provision of our Services.

6. Privacy

As a result of our internal practices set out above and the general nature of email communication, there is a possibility that email communications are intercepted or that a privacy breach occurs.  You can choose not to communication with us via email if you are concerned about your privacy. 7. Third Party Service Providers and Force Majeure Events

Harwood Andrews relies on various third party service providers such as telecommunications and internet service providers.  Without limitation, these are based in Australia, the EU, UK, USA and Asia Pacific countries. Harwood Andrews will not be liable for delays, damages or the non-availability of email and related services which are beyond its control due to third party dependencies and force majeure events.

8. Bank Account Details- Email Security

We do not expect our bank account details to change. In the unlikely event that they do, we will contact you by telephone or in person to notify you of any change. We will not notify you by email.

If you do receive any bank account details or payment instructions via email, the differing details should be presumed fraudulent. Do not send any funds and contact us immediately.

9. Damages Arising from Email from Harwood Andrews

Email technologies and the use of related telecommunication systems and networks expose Harwood Andrews to dynamic security and business risk. Harwood Andrews manages this risk in accordance with Australian law, relevant international law, international standards, best practice and through its policies, procedures and guidelines to prevent unauthorised access to or abuse of its systems and networks. While Harwood Andrews is committed to a reasonable standard of care and diligence, Harwood Andrews will not be liable for damages arising from the use of email which are beyond its control.

10. Dispatch and Receipt of Email

Senders of email addressed to Harwood Andrews agree that email is deemed received by Harwood Andrews only when receipt is acknowledged by a Harwood Andrews representative. Email from Harwood Andrews will be deemed dispatched as and when reflected in the Harwood Andrews mail server logs. For all purposes, the place of dispatch and receipt of email from and to Harwood Andrews is Geelong in Victoria, Australia.

11. Governing Law

The principles outlined in this Email Legal Notice are governed by Australian law.

12. Skill, Diligence, Care

Harwood Andrews will exercise reasonable skill, diligence and care as may reasonably be expected from a similar service provider.
